Daryl Douglas
Harness Racing Victoria (HRV) Stewards had previously suspended Mr Daryl Douglas for six weeks for breaching HRV Rule 149(1), in that he failed to take all reasonable and permissible measures during the course of a race to ensure that Wizard Of Speed NZ was given full opportunity to win or obtain the best possible placing in the field at the Shepparton harness meeting on 2 April 2009.
Mr Douglas appealed this decision to the HRV Independent Appeals Panel on 16 April 2009 where they matter was dismissed, however the penalty was varied to four weeks.
Mr Douglas then subsequently appealed that decision to the Racing Appeals Tribunal. The matter was heard on 18 May 2009 with the decision being handed down today by His Honour Judge Williams.
In dismissing the appeal the Tribunal found that Mr Douglas was culpable and the charge issued by Stewards was proven. After hearing submissions from both parties, penalty was varied to a suspension of three weeks. The suspension of Mr Douglas will commence midnight 20 May 2009.
